Writing Flame Terms and Conditions

1. Acceptance of Terms

By accessing, downloading, or using the Writing Flame mobile application and related services (collectively, the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the App.

2. Eligibility

The App is intended for use by individuals who are at least 18 years of age and who possess the legal authority to enter into binding contracts. By using the App, you represent and warrant that you meet these eligibility requirements. The App is a general audience service and is not directed at children under the age of 14. We do not knowingly collect personal information from children under 14.

3. Definitions
  • App: The Writing Flame platform, including all its features, websites, and services.
  • User, You, Your: Any individual or entity using the App.
  • Client: A User who posts a project and purchases services from a Writer.
  • Writer: A User who is approved by us to offer and provide writing services to Clients through the App.
  • Project: A request for writing services posted by a Client.
  • Deliverable: The final written work product submitted by a Writer to a Client for a Project.
  • Earnings: The compensation payable to a Writer for a completed Project, minus any applicable service fees.
  • Content: Any text, image, or other material uploaded to the App by a User.
4. Account Registration and Security

To access certain features, you must register for an account. You agree to provide accurate and complete information and to keep this information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Writer Application and Onboarding

To become a Writer, you must complete an application process, which may include skill assessments, submission of writing samples, and verification of your identity. We reserve the sole right to approve or deny any application at our discretion and are not obligated to provide a reason for denial. Upon approval, your account will be activated, granting you access to available Projects.

6. Writer Obligations and Conduct

As a Writer, you agree to:

  • Provide high-quality, original content that is free of plagiarism and generated by you. The use of AI-generated content (e.g., from ChatGPT or similar tools) must be explicitly authorized by the Client and disclosed to them; otherwise, it is strictly prohibited.
  • Adhere strictly to all instructions, deadlines, and formatting guidelines provided by the Client for each Project.
  • Communicate professionally and promptly with Clients and our support team through the App's designated communication channels.
  • Maintain the strict confidentiality of all Project details and Client information.
  • Not solicit or accept payment outside of the App's official payment system for any work arranged through the App.
  • Warrant that all Deliverables are your original work and do not infringe upon any third party's copyright, trademark, or other intellectual property rights.
7. Client Obligations and Conduct

As a Client, you agree to:

  • Provide clear, complete, and lawful instructions for each Project.
  • Pay for accepted Deliverables in accordance with the agreed-upon price and these Terms.
  • Communicate professionally and respectfully with Writers.
  • Use the Deliverables for their intended purpose and in accordance with the license granted (see Section 10: Intellectual Property).
8. Payment Terms

For Clients: You authorize Writing Flame to charge your chosen payment method for the full amount of a Project upon your acceptance of a Writer's proposal or agreement on terms. Funds will be held in escrow until the Project is completed and you accept the Deliverable.

For Writers: Your Earnings for a completed and accepted Project, minus our service fee, will be credited to your account balance. You may request a payout once your balance meets the minimum threshold of $50. Payouts are processed on the 1st and 15th of each month via your selected payment method (e.g., PayPal, Bank Transfer). You are responsible for providing accurate payout information.

Refunds and Disputes: Refund requests are handled on a case-by-case basis. If a Deliverable does not meet the Project's requirements, the Client may request revisions in accordance with our revision policy. We may mediate disputes and, if necessary, refund a Client, which may result in a corresponding deduction from the Writer's Earnings.


9. Content Standards and Ownership

User-Generated Content: You are solely responsible for the Content you upload. You represent that you own or have the necessary rights to all such Content.

Plagiarism: All Deliverables must be original works. Writers are expected to cite sources appropriately. Plagiarism is a material breach of these Terms.

Copyright Infringement (DMCA): We respect intellectual property rights. If you believe your copyright has been infringed, please follow our DMCA policy outlined on our website.

10. Intellectual Property License

Upon a Client's full payment for a Deliverable, the Writer grants the Client a perpetual, worldwide, non-exclusive license to use the Deliverable for its intended purpose. The Writer retains the underlying copyright unless a separate "Work for Hire" agreement is signed, explicitly transferring full copyright to the Client.

By submitting any Content to the App, you grant Writing Flame a royalty-free, worldwide license to use, display, and distribute that Content as necessary to operate and provide the App's services.

11. Termination

You may deactivate your account at any time by contacting support, provided all financial obligations are settled. We reserve the right to suspend or terminate your account immediately, without notice, for any breach of these Terms, including but not limited to fraud, plagiarism, abusive behavior, or attempts to circumvent the App's payment system.

12. Disclaimer of Warranties; Limitation of Liability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, Writing Flame SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via the App or by email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
